        A-Mark's Privacy Statement

Thank you for accessing this website (“Site”) operated by A-Mark Precious Metals, Inc. (“A-Mark”). We respect your privacy and want to protect your personal information. To learn more, please read this Privacy Policy. This Privacy Policy explains how we collect, use and (under certain conditions) disclose your personal information. This Privacy Policy also explains the steps we have taken to secure your personal information. Finally, this Privacy Policy explains your options regarding the collection, use and disclosure of your personal information. By visiting the Site directly or through another site, you accept the practices described in this Policy. This privacy policy applies to the Site. This privacy policy does not apply to any offline collection of your personal information, except as explained below. Please see below for details. We are not responsible for the content or privacy practices on any website not operated by A-Mark to which the Site links or that links to the Site.

        INFORMATION COLLECTION AND USE

        1. Information Collection.

We collect information from you in several different ways on this Site. One goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we can use your personal information to:

        • Help us create content that is most relevant to you.
        • Alert you to new information, products, and services that we offer.

        1. Account Creation and Products. Before accessing certain features on the Site, you must open an online account. When you create your account, you will be prompted to provide to us certain personal information including, but not limited to, your name, address, telephone number and email address. If you choose to purchase or sell a product online, we may ask for your name, telephone number, billing address, credit card number and related information. These kinds of personal information are used for billing purposes, to fulfill your orders, to communicate with you about your order and the Site, and for internal marketing purposes. If we encounter a problem when processing your order, your personal information may be used to contact you. We may also use your personal information to verify the delivery or credit card information or otherwise conduct due diligence to ensure proper processing of your order and to minimize the risk of fraudulent transactions. In conducting due diligence, we may acquire additional personal information from third parties. We also may verify your personal information including addresses and telephone numbers using third party providers.
        2. Forms and applications. You may download forms or applications from the Site that you may then transmit to A-Mark. These forms ask for personal information that may include your name, address, telephone number, driver's license number, email address, Social Security Number, date of birth, and financial information. Depending on the form or application, this information may be used to set up an account, to complete an order, to contact you about your order, to provide email news alerts and other email marketing, and for internal marketing purposes.
        3. Email Addresses. Several locations of the Site permit you to enter your email address for purposes including but not limited to: creating an account and purchasing or selling a product online.
        4. Log Files. As is true of most web sites, the Site server automatically recognizes the Internet URL from which you access the Site. We may also log your Internet protocol ("IP") address, Internet service provider, and date/time stamp for system administration, order verification, internal marketing, and system troubleshooting purposes. (An IP address may indicate the location of your computer on the Internet.)
        5. Our Company Commitment to Children's Privacy. Protecting children's privacy is especially important to us. It is our policy to comply with the Children's Online Privacy Protection Act of 1998 and all other applicable laws. We therefore do not knowingly or intentionally collect personal information from persons who are under eighteen (18) years of age. If you are under the age of eighteen (18), you are not permitted to access this website and/or to submit any personal information via this website. Due to the age restrictions for use of this website as stated herein, no information obtained by this website falls within the purview of the Children's Online Privacy Protection Act, and information submitted to this site is not monitored for such purposes.

        2. Cookies and Other Technology. Like many sites, the Site employs cookies and web beacons (also known as clear GIF technology or "action tags") to speed up your navigation of the Site, recognize you and your access privileges, and track your Site usage.

        1. Cookies are small pieces of information that are stored as text files by your Internet browser on your computer's hard drive. Most Internet browsers are initially set to accept cookies. You can set your browser to refuse cookies from web sites or to remove cookies from your hard drive, but if you do, you will not be able to access or use portions of the Site. We have to use cookies to enable you to select products, place them in an online shopping cart, and to purchase those products. If you do this, we keep a record of your browsing activity and purchase. THE SITE'S COOKIES DO NOT AND CANNOT INFILTRATE A USER'S HARD DRIVE TO GATHER A USER'S CONFIDENTIAL INFORMATION. Our cookies are not "spyware."
        2. Web beacons assist in delivering cookies and help us determine whether a web page on the Site has been viewed and, if so, how many times. For example, any electronic image on the Site, such as an ad banner, can function as a web beacon.
        3. Where cookie technology is unavailable we may use an anonymous identifier to speed up your navigation of the Site, recognize you and your access privileges, and track your Site usage. An anonymous identifier is a random string of characters that is used for the same purposes as a cookie on platforms, including certain mobile devices, where cookie technology is not available.
        4. We may use third-party advertising companies to help tailor site content to users or to serve ads on our behalf. These companies may employ cookies and web beacons to measure advertising effectiveness (such as which web pages are visited or what products are purchased and in what amount). Any information that these third parties collect via cookies and web beacons is not linked to any personal information collected by us.
        5. As an example, Facebook collects certain information via cookies and web beacons to determine which web pages are visited or what products are purchased. Please note that any information collected by Facebook via cookies and web beacons is not linked to any customer's personal information collected by us.

        3. Information Use and Disclosure.

        1. Internal Use. We use your personal information to process your orders, provide requested information, and provide you with customer service. We may internally use your personal information to improve the Site’s content and layout, to improve outreach, and for our own marketing efforts (including marketing our services and products to you), and to determine general marketplace information about visitors to the Site.
        2. Communications with You. We will use your personal information to communicate with you about the Site and your orders, requests for information, and deliveries. Also, we may send you a confirmation email when you register or order with us. We may send you a service-related announcement on the rare occasions when it is necessary (for example, if we must temporarily suspend our service for maintenance). Also, you may submit your email address for reasons such as sign up for email news alerts and special offers or to request free information about acquiring precious metals. If you submit your email address, we use it to deliver the information to you. We always permit you to unsubscribe or opt out of future emails (see the “Your Rights” section below for more details). Because we have to communicate with you about orders that you choose to place, you cannot opt out of receiving emails related to your orders.
        3. External Use. We share the information we collect from and about you among affiliates of A-Mark, including parents, subsidiaries and companies in which we, a parent and/or subsidiary have an ownership interest or other relationship.
        4. A-Mark may contact you at the phone number and email you provide for marketing and other reasons, including possibly using automated technology. You are not required to consent in order to purchase as you can always call us directly.
        5. As do many retailers, we sometimes use third parties to perform specific functions on our behalf. When we disclose information to these service providers, we disclose information to help them to perform their service. For example, in order to deliver products to you, we must share some information. We work with third parties (such as UPS?) to ship products, to ensure delivery, and so that we can obtain feedback, improve the quality of our service and measure and improve the quality of the service of the third party. In the example of shippers, we provide them with some personal information such as your name, shipping address, email, and phone number.
        6. Similarly, to help you buy products and provide customer service to you, we must provide your credit card number to financial services corporations such as credit-card processors.
        7. We may disclose personal information in response to requests from law enforcement officials conducting investigations; subpoenas; a court order; or if we are otherwise required to disclose such information by law. We also will release personal information where disclosure is necessary to plrotect our legal rights, enforce our agreements, or to protect ourselves or others. For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use the Site for illegal reasons or to commit fraud.
        8. We might acquire or merge with or be acquired by another company or we might dispose of some or all of our assets. If that happens, your personal information may be disclosed or transferred to another company.

        DATA SECURITY

The security and confidentiality of your information is important to us. We have implemented certain technical, administrative, and physical security measures designed to help protect customer information from unauthorized access and improper use. This is an ongoing process and, from time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware that, despite a company's best efforts, no security measures are perfect or impenetrable.

The Site incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information, including Secure Sockets Layer ("SSL") for all financial transactions through the Site. We use SSL encryption to protect your personal information online, and we also take several steps to protect your personal information in our facilities. Personal information may be printed or otherwise stored in a non-electronic form. Employees who need access to your personal information to perform a specific job are permitted access to your personal information. Finally, we may rely on third-party service providers for the physical security of some of our computer hardware. We believe that their security procedures are adequate. For example, when you visit the Site, you access servers that are kept in a secure physical environment, behind a locked cage and an electronic firewall. A-Mark does not guarantee complete security either online or offline.

        GOOGLE ANALYTICS PRIVACY POLICY

This website uses Google Analytics, a web analytics service provided by Google, LLC ("Google?") to collect information about use of this site. Google Analytics collects information such as how often users visit this site, what pages they visit when they do so, and what other sites they used prior to coming to this site. We use the information we get from Google Analytics only to improve this site. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personal information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

        DATA RETENTION

We will retain the personal information we receive as described in this privacy policy for as long as necessary to fulfill the purpose(s) for which it was collected, pursue legitimate business purposes, and comply with all applicable laws and in accordance with our routine information storage policies.

        MONITORING/RECORDING OF TELEPHONE CALLS

Every telephone conversation between you and A-Mark – whether you place a call to A-Mark or whether any A-Mark representative calls you – is subject to monitoring and/or recording. Any conversations between you and any A-Mark representative are not confidential or private. A-Mark is not obligated to record or monitor telephone conversations with you but can, in its sole discretion, choose to do so and permit appropriate third-party monitors to do so on A-Mark’s behalf. A-Mark monitors and records telephone conversations with its customers for quality control and for A-Mark’s protection. At the same time, unless otherwise agreed by A-Mark’s management in writing, A-Mark does not consent to the recording of telephone conversations by you or by any other party on your behalf. This Site is intended for individuals 18 years of age and older.

        CROSS-BORDER TRANSFER

Your personal information may be stored and processed in any country where we have offices or servers or in which we engage service providers. Your personal information may be transferred to countries outside your country of residence that may have different data protection and data processing laws than those in your country. Our Privacy Policy requires all of our offices to at all times ensure a level of protection at least as protective as those mandated by the European Economic Area. Any such transfer shall take place only in accordance with and as permitted by the law of your jurisdiction, but please be aware that the laws and practices relating to the protection of personal information are likely to be different and in some cases may be weaker than those within your home jurisdiction. Regardless, in all events, we shall apply the provisions of this Privacy Policy to your personal information wherever it is located.

OFFLINE COLLECTION, USE & DISCLOSURE OF INFORMATION

A-Mark may collect personal information from you offline. When you communicate with A-Mark offline, we may ask for the personal information we need in order to place an order, answer a question, create a A-Mark client account, or otherwise respond to an inquiry. When we need to store information (such as order information), we will enter it into our customer database(s). There are other ways we could learn of personal information offline (for example, when we receive wire instructions, checks or correspondence), and this Policy does not discuss or try to predict all of those methods or the use that will be made of such information. A-Mark will, as appropriate and practicable, treat offline collection, uses, and disclosures of customer personal information consistently with our relevant online practices. You should know that we generally use personal information collected offline in a similar manner to how we use personal information which is collected online, as outlined above.

        YOUR RIGHTS

To the extent required by law, we provide you with reasonable access to the personal information that you have provided to us, a portable copy of the information, and the ability to review, correct, delete, restrict or object to the processing of such information. Additionally, you can request to unsubscribe to emails by telephoning A-Mark at (310) 587-1443, by emailing your request to privacy@amark.com, or by using the “unsubscribe” link found within our marketing emails. Please do not email your credit-card information or any other sensitive information.

Although we make good faith efforts to provide individuals with access to their personal information, there may be circumstances in which we are unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question or where the information is commercially proprietary. If we determine that access should be restricted in any particular instance, we will endeavor to provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, we will take commercially reasonable steps to verify your identity before granting access to or making any changes to your personal information.

If you would like to review or update your personal information or preferences, or have your information removed from our mailing lists, please let us know by emailing us at privacy@amark.com or by writing us at the addresses listed below.

        YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits customers of A-Mark who are California residents to request certain information regarding its disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to privacy@amark.com or write us at the addresses listed below.

        DISPUTE RESOLUTION

EU residents may report privacy complaints directly to their local data protection authorities. You may also contact us to be directed to the relevant authorities.

        UPDATES TO THIS POLICY

If we change or update this Privacy Policy, we will post changes and updates on the Site so that you will always be aware of what information we collect, use and disclose.
